Prosecutors drop a Weinstein rape charge after two juries deadlocked

New York prosecutors have dropped a third-degree rape charge against Harvey Weinstein after two separate juries failed to reach a verdict on the count and the accuser declined to testify at another trial. With no realistic path to a conviction on that charge, the office moved to dismiss it rather than pursue a third trial.

The decision resolves one count in a case that has been retried and reshaped since Weinstein’s original 2020 conviction was overturned on appeal. It does not erase his other legal exposure, and prosecutors framed the move as a recognition of the practical limits of retrying a charge two juries could not decide rather than a judgment on the underlying allegation.
