Alibaba sues Pentagon over 'Chinese military company' designation
Alibaba filed suit in federal court in San Jose on June 23 to challenge the Defense Department’s decision to brand it a “Chinese military company.” The Pentagon added Alibaba to the list on June 8 alongside firms including BYD and Baidu; the company says the determination “has no basis in fact or law” and points to an independent board with no military ties.
The designation carries concrete commercial consequences. As of June 30, listed firms cannot supply goods, services, or technology to the Defense Department, and from 2027 the Pentagon is barred from contracting with them even indirectly. The Pentagon argues Alibaba contributes to China’s defense industrial base through ties to the Ministry of Industry and Information Technology.
The list has grown to 188 companies, up from 134 in 2025, and a designation often prompts wider commercial caution beyond the formal contracting ban. Alibaba follows other Chinese firms that have sued — some successfully — to be removed, making the case a test of how much evidence the Pentagon must marshal to defend a listing.
