The Trump administration is moving two of the Education Department’s core functions to other agencies, NPR reported : oversight of special education shifts to the Department of Health and Human Services, and enforcement of civil rights in schools moves to the Justice Department.
The reassignment continues the dismantling of an agency the president has said he wants to eliminate. Both functions are anchored in federal statute — the Individuals with Disabilities Education Act and federal civil rights law — so relocating where they are administered raises questions about staffing, continuity, and legal authority that are likely to draw court challenges.
